Export Controls & Sanctions Notice
Trade-control requirements governing access to covered Aeltrix Technologies LLC software, technology, services, and technical information.
1. Scope
This Notice supplements the Terms of Service and applies to software, source code, object code, APIs, technical information, hosted services, support, professional services, downloads, credentials, and other items or activities subject to applicable export-control or economic-sanctions laws.
2. U.S. Export Administration Regulations
U.S. export-control laws may regulate the export, reexport, transfer, release, or access to commodities, software, and technology. Customer is responsible for determining whether its use, destination, users, data, integrations, or onward transfers create licensing, classification, end-use, or end-user obligations.
3. Sanctions
Customer may not use the Services in violation of sanctions administered by the U.S. Department of the Treasury's Office of Foreign Assets Control or other applicable sanctions authorities. Aeltrix may restrict access, transactions, support, or provisioning where necessary to comply with applicable sanctions.
4. Restricted Parties
Customer represents that it is not, and will not knowingly permit access by, a person or entity prohibited from receiving the applicable Services under sanctions, export restrictions, denied-party rules, or other trade-control laws. Customer must conduct appropriate screening where required by its activities and risk profile.
5. Restricted Destinations
Services may not be made available, directly or indirectly, in or to destinations where doing so is prohibited without required authorization. Geographic availability shown on a website or infrastructure region list is not a representation that every Service may lawfully be supplied to every customer in that location.
6. Prohibited End Uses
Customer may not use the Services for prohibited nuclear, missile, chemical or biological weapons, military-intelligence, surveillance, advanced-computing, semiconductor, weapons, or other restricted end uses where applicable law prohibits the activity or requires authorization that has not been obtained.
7. Encryption and Technical Controls
Some software, encryption functionality, technical data, or security technology may be subject to special classification, reporting, or licensing rules. Customer may not alter, route, export, or provide access to such items in a manner designed to evade applicable controls.
8. Customer Information
Aeltrix may request ownership, location, end-user, end-use, citizenship, organization, or other information reasonably necessary to conduct compliance screening. Failure to provide sufficient information may result in delayed provisioning, restriction, or cancellation.
9. Geolocation and Access Controls
Aeltrix may use IP-based controls, account location data, payment information, identity information, screening vendors, or other risk signals to support compliance. Such controls are risk-management measures and do not transfer Customer's legal responsibility to Aeltrix.
10. Licenses and Authorizations
If a license, license exception, general license, specific authorization, or other governmental approval is required for Customer's activity, Customer must obtain and maintain it before using the Services for that activity unless Aeltrix expressly agrees in writing to obtain it.
11. Suspension and Blocking
Aeltrix may reject, hold, block, restrict, or terminate a transaction, account, resource, or support activity where reasonably necessary to comply with applicable law, governmental orders, sanctions, export controls, or internal compliance controls. Funds or property may be blocked where legally required.
12. No Advice
